What is mediation?
Mediation is a voluntary process in which parties work out a settlement. The parties in a mediation are assisted by a neutral third party (the mediator). The mediator cannot compel either party to reach a deal but can help the parties work together. A mediator acts to build understanding, consensus, and agreement among parties. Mediation can often be a cost and time efficient alternative to litigation. Mediation can also be helpful in preserving or rebuilding an ongoing relationship.
What is arbitration?
Arbitration is a process by which the parties hire a third party to review their evidence and decide their dispute. An arbitration award may be enforced in a court of law after the arbitration is concluded. Parties may also agree to mediate and, if mediation is not successful, to have their mediator make a decision that binds both parties if an agreement is not reached. This process is known as mediation-arbitration.
What is early neutral evaluation?
In an early neutral evaluation, the mediator provides the parties with an opinion as to the relative strengths, issues, and value of their cases based on information provided by the parties or their counsel. While a mediator acting in this capacity is not an attorney for either party, the opportunity to have a candid discussion about ta caseoften proves useful in deciding what sort of settlement would make sense.
