Business Litigation
Co-counsel for multiple entities in complex financial fraud scheme against Fortune 50 company claiming over $30 million in damages; matter settled.
Represented national trivia company in partnership dispute. Matter dismissed at trial court level.
Represented corporation in action to recover proceeds of embezzlement and fraud from high level employee.
Represented physician in dispute with former business partner; matter settled.

Represented company and owner in partnership dispute alleging over $30 million in damages; trial court judgment for clients.
Trial counsel for plaintiff in partnership dispute concerning operation of marijuana business. Verdict in excess of $100,000 for Plaintiff.
Represented licensed marijuana company in regulatory investigation; matter resolved with consent agreement.

Construction Industry Experience
Represented high end residential contractor in dispute with homeowner. Obtained dismissal of claims which was affirmed on appeal.
Represented owner against former contractor for violation of Colorado Trust Fund Act; contractor prosecuted and convicted of fraud.
Counsel for two plaintiffs in action against Colorado based engineer relating to defective design of HVAC system in a commercial cannabis grow.
Handled claims against equipment manufacturer and facilities designer relative to defective design of cannabis grow.
Represented national contractor in suit against owner of $100 million development.
Associate counsel for defendant in trial of action by office building owner and mortgagee claiming over $44 Million in damages as a result of breach of contract, construction defects, and fraud. Team obtained partial summary judgment for defendant on contract and related claims; jury verdict for defendant on all fraud claims.

Mediations
Mediations are by nature confidential and, therefore, the specifics of cases we have mediated are not listed because they could indirectly be used to identify clients we have worked with. However, in general, Eric has mediated business disputes, breach of contract cases, domestic cases involving parenting time or financial support, collection actions, and real estate cases (including partition acts), and tort cases, among others.
Partnership, Shareholder and Member Disputes
Represented plaintiff in action against land developer for fraud and related conduct concerning development of a $50 million resort; matter settled.
Represented plaintiff in case against multiple defendant involving ownership of closely held corporation worth $3-$5 million. Jury verdict on liability in favor of Plaintiff. Matter settled thereafter.
Represented two individual and two corporate defendants in commercial contract dispute concerning ownership of medical marijuana center. Matter settled.
Represented plaintiffs in legal malpractice action involving multiple attorneys and a regional law firm and disputes regarding the ownership of a closely held business.
Represented plaintiff in business dispute concerning ownership of business; matter settled.
Represented plaintiff in securities act and other claims relating to investment in business; matter settled.
Represented defendant in dispute over ownership of financial services firm; matter settled.
Associate counsel representing special litigation committee of the Board of Directors of publicly traded company. Provided advice and counsel to Board regarding complex derivative claims.

Securities Litigation
Represented plaintiff in litigation against company and related individuals who elicited investments in agricultural land by fraud; matter resolved.
Represented plaintiff in securities arbitration against two corporate and one individual defendant in securities related claims; matter resolved.
Represented company and individual in response to Colorado Division of Securities subpoena and investigation; matter resolved.
Trial counsel for two corporate and three individual defendants in action brought by the Colorado Division of Securities. Obtained judgment by trial court which was affirmed on appeal.
Represented Defendant in securities fraud claim alleging theft of $500,000 investment during pending investigations by state and local authorities. Matter settled.
